Our commitment includes full compliance with the Health Insurance Portability and Accountability Act (HIPAA), a federal law designed to safeguard the privacy and security of health information. We have implemented a number of safeguards to protect your personal information, including: Physical Security: Personal information is not stored online or in a database accessible externally. All data is offline and safeguarded with username and password protection.

Technical Security:
We enhance the security of your personal information through encryption as an additional protective measure.

Administrative Security:
Our administrative personnel only have access to members under their responsibility. Every instance of database access for personal information by an administrator occurs in the presence of another administrator, serving as a checks-and-balances system for proper access.

Sole and Exclusive Administrative Access:
Our system ensures that only two designated administrators possess unrestricted and direct access to all information, irrespective of the member’s situation, status at any given time, for whatever reasons deemed necessary and whenever mandated.

GOVERNING LAW

Any dispute arising from the website and your use of  our services will be governed by and enforced in accordance with the laws of the state of Florida, except to the extent preempted by U.S. federal law, without regard to conflict of law rules or principles (whether in Florida or any other jurisdiction) that would cause the application of the laws of any other jurisdiction. Any dispute between the parties is subject to arbitration in Palm Beach County, Florida only.

Careful Advocate provides non-medical managed care and support services, and we do not offer medical advice, diagnosis, or treatment. Our services are not a substitute for professional medical care or for professional advice, and we recommend consulting with qualified healthcare professionals for medical concerns.

Volunteer Support:

Our services involve the use of local volunteers (“Advocates”}  dedicated to creating customized no cost caring experiences for our clients. Whether disagreements arise among members, clients, contractors, volunteers, or any other party involved, our commitment to transparent and compassionate care extends to the resolution of conflicts.

Voluntary Mediation:
Disputes that may arise within the realm of our non-medical care services are ideally addressed through voluntary mediation. Mediation is an alternative dispute resolution process where an impartial mediator facilitates communication between parties to reach a mutually agreeable resolution.

Open Communication:

Careful Advocate emphasizes the importance of open communication and encourages parties involved in a dispute to engage in mediation willingly. This process allows for a confidential and cooperative environment where participants can express their concerns and work collaboratively towards a resolution.

Careful Advocate acknowledges that certain conflicts may have legal implications. In such cases, parties involved are required to use mediation as a means to resolve their disputes. You agree there can be no lawsuit(s) whatsoever and for any reasons.

Our commitment to the well-being of our members extends beyond the provision of managed care services. Careful Advocate aims to contribute to a harmonious and supportive community environment.

When you utilize our services, you understand and agree that in the event any executive, advocate, employee, contractor, or affiliated service provider is requested to participate in a deposition, mediation, or any pre-court, court or court proceedings, you are responsible for covering travel time, expenses, room and board, along with a rate of $250.00 per hour, billed in 15-minute increments. An agreed-upon estimated retainer amount must be paid in advance of participation, and the final bill will be presented for refund or payment within 24 hours, with payment required within the subsequent 24 hours. Late payments will incur an 8 percent interest charge.
